Distance Sales Agreement

BUYER: The person or business whose billing details are entered at checkout, and the authorised person acting on their behalf. The buyer's name or company name, address, email, phone and tax or identity number are recorded at checkout and form an integral part of this agreement.

2. Subject

This agreement sets out the rights and obligations of the parties regarding the sale and performance of the BirSitem plan ordered electronically by the Buyer on https://birsitem.com, in accordance with Law No. 6502 on Consumer Protection and the Distance Contracts Regulation.

3. Service and price

BirSitem is an online website builder. Depending on the plan, the service includes ready-made templates, a drag-and-drop editor, hosting, SSL, a birsitem.com address or the Buyer's own domain, contact forms, blog posts, an online store, team members and visitor statistics. Plan contents are published on https://birsitem.com/fiyatlar.

The Buyer orders the plan and billing period (monthly or yearly) selected at checkout. Current prices on the date of the agreement:

Personal: TRY 79 per month or TRY 799 per year (VAT included); 10 pages, 5 GB storage, 2 users.

Business: TRY 139 per month or TRY 1,299 per year (VAT included); 50 pages, 25 GB storage, 5 users.

Professional: TRY 849 per month or TRY 8,299 per year (VAT included); unlimited pages, unlimited storage, unlimited users.

With yearly billing on eligible plans, one domain name is provided free of charge for the first year, subject to the extension and price limits stated on the site. Renewal from the second year is paid by the Buyer.

4. Payment and renewal

Payment is taken by credit or debit card through the iyzico payment infrastructure, or by bank transfer. Card details are never stored on Seller's servers; they are processed by iyzico in line with PCI-DSS.

For card subscriptions with automatic renewal, the plan fee is charged to the same card at the start of each period (monthly or yearly) until the Buyer cancels. If automatic renewal is not chosen, or the payment fails, the plan is not renewed and the site moves to the Free plan at the end of the period: content is not deleted.

Prices may change for future periods; changes never affect a period that has already been paid and are announced before the renewal date.

5. Performance

The plan is activated on the Buyer's site immediately after the payment is confirmed (for bank transfers, after the transfer is received and approved). The service is provided over the internet; Seller takes reasonable care to keep it available and announces planned maintenance in advance where possible.

Upgrades take effect immediately. Downgrades and cancellations take effect at the end of the prepaid period.

6. Right of withdrawal

The Buyer expressly agrees that performance of the digital service starts immediately upon payment and accepts that, under Article 15(1)(ğ) of the Distance Contracts Regulation, there is no right of withdrawal for services performed instantly in electronic form. Domain names registered for the Buyer cannot be returned or exchanged.

The Buyer can turn off automatic renewal or cancel the plan at any time from the dashboard; cancellation takes effect at the end of the paid period and the fee for that period is not refunded. If the service is unavailable for more than 72 consecutive hours for reasons attributable to Seller, the Buyer may request a proportional refund.

7. Invoice

An e-archive invoice is issued for every payment using the billing details provided by the Buyer and sent to the registered email address. The Buyer is responsible for the accuracy of the billing details.

8. Buyer's obligations

The Buyer will not share their account, is responsible for the content published on their site and for related legal obligations (including the Personal Data Protection Law and the e-commerce legislation for online stores), and will not use the service for unlawful purposes. The Terms of Use (https://birsitem.com/en/kullanim-sartlari) are an annex to this agreement.

9. Personal data

Personal data processed during payment and subscription is subject to the Privacy Policy at https://birsitem.com/en/kvkk.

10. Disputes

For consumer buyers, Consumer Arbitration Committees at the buyer's place of residence have jurisdiction within the monetary limits announced each year by the Ministry of Trade, and Consumer Courts above those limits. For merchant buyers purchasing for commercial purposes, the courts and enforcement offices at Seller's place of business have jurisdiction.

11. Entry into force

By approving the Preliminary Information Form and this agreement electronically at checkout, the Buyer accepts all terms of the agreement. The approval record (date, IP address, version) is kept by Seller and provided to the Buyer on request.
