Terms of Use

1. Parties and scope

These terms govern the use of the BirSitem website-building service offered at birsitem.com (the “Service”) and set out the relationship between the business providing the Service (“BirSitem”) and the person who creates an account (the “Member”).

If you use the Service on behalf of a business, you confirm that you are authorized to represent that business.

2. Description of the Service

BirSitem provides website building with ready-made templates and a drag-and-drop editor, publishing of the site on a birsitem.com subdomain or on the Member’s own domain, hosting, SSL certificates, contact forms and visitor statistics.

The scope of the Service varies by plan. Current plans and prices are published on the website.

3. Membership and account security

To become a member, you must provide accurate and up-to-date information and verify your email address. Your account is personal to you; you must not share your password or the sign-in codes sent to your email with anyone.

You are responsible for all activity carried out through your account. If you notice any unauthorized use, change your password and let us know.

4. Free trial, plans and payment

Every new site can be tried free of charge for 14 days. At the end of the trial period, a plan must be purchased for the site to remain online.

Plan fees are paid in advance and cover the selected billing period (monthly or yearly). For payments made by bank transfer (Havale / EFT), the plan is activated once the payment has reached our account and your payment notification has been approved.

When a plan expires, the site is taken offline; your content is not deleted, and the site goes back online when the plan is renewed. Prices may be changed for future periods; periods that have already been paid for are not affected.

Your rights under consumer protection legislation are reserved. You can contact our support team regarding cancellation and refund requests.

5. Content and publishing rules

You are solely responsible for the text, images, videos and links you add to your site. You confirm that the content belongs to you or that you have the right to use it.

The following content may not be published:

• content that is unlawful, constitutes a criminal offense or incites one
• content that infringes the copyrights, trademarks or personal rights of others
• fraud, phishing, misleading commercial practices and illegal betting / gambling
• hate speech, harassment, violence and any content involving the abuse of children
• content that spreads malware or endangers the security of visitors

6. Site approval and moderation

Sites are reviewed by BirSitem when they are published for the first time. BirSitem reserves the right to refuse approval of, or take offline, any site it finds to be in breach of these terms, and to suspend the membership in the event of repeated violations.

The footer of sites built with BirSitem includes the notice “Made with BirSitem”.

7. Domain names

Subdomains (example.birsitem.com) belong to BirSitem and are made available for your use for the duration of your membership. Addresses that are misleading or inappropriate, or that suggest another party’s trademark or trade name, may be rejected.

If you connect your own domain, you are responsible for its registration, renewal and DNS settings.

8. Intellectual property

The BirSitem software, design, templates and brand belong to BirSitem. You may use the templates and the images in the library only on sites you publish with BirSitem.

The content you add to your site belongs to you. You grant us permission to use that content to the extent necessary to provide the Service (hosting, display and backup).

9. Third-party services

Videos, maps and embedded content that you can add to your site (e.g. YouTube, Google Maps, booking and form services) are provided by third parties and are subject to their own terms. We are not responsible for interruptions to these services or for their content.

10. Service continuity and limitation of liability

We make reasonable efforts to keep the Service running without interruption or errors; however, interruptions may occur due to maintenance, failures at our infrastructure providers or force majeure.

To the extent permitted by law, we are not liable for indirect damages (loss of profit, loss of data, loss of reputation). In all cases, our liability is limited to the plan fee you paid for the period in which the damage occurred.

11. Closing your account

You may end your membership at any time. You can delete your account from the My Account page in your dashboard; your account and sites are closed immediately and kept for 7 days (during which you can have them restored by submitting a support request), and are then permanently deleted at the end of that period, subject to our legal retention obligations.

We may suspend or terminate the membership in the event of serious or repeated violations of these terms.

12. Changes and governing law

We may update these terms. We will announce significant changes on the website or notify you by email; continuing to use the Service after a change means that you accept the updated terms.

These terms are governed by the laws of the Republic of Türkiye. Consumer arbitration committees and consumer courts have jurisdiction over consumer transactions.
